California ban on gay marriage unconstitutional

California's ban on same-sex marriage is unconstitutional, a state superior court judge ruled on Monday, setting the stage for a renewed round of legal challenges to gay rights.

“It appears that no rational purpose exists for limiting marriage in this state to opposite-sex partners,” Judge Richard Kramer wrote in a ruling on suits brought a year ago by the city of San Francisco and 12 gay and lesbian couples.
