The talk, of late, across London dinner tables has been of prenuptial agreements and divorce. Previously in the UK, prenups were not worth the paper they were written on. But, with a watershed court ruling some two weeks ago, there are some panicked spouses about. Lord Justice Thorpe declared that any system that held such contracts to be void was “increasingly unrealistic”. As for Katrin Radamacher, the plaintiff in question, a German heiress who divorced her French husband, she stated simply: “Nicolas and I made each other a promise and all I have been asking is that he be kept to it.”
All this is of great interest to my wealthy clients, not least because, when assets are divided, property becomes a contentious issue. Battles are waged and trophies seized or, in some cases, disposed of for quick cash. She wants the London flat and the Caribbean condo but couldn’t care less about the Scottish hunting lodge. But he can’t afford a new place in the city without selling both the condo and the lodge and that will happen over his dead body. It goes on.
