Akzo setback in test case on legal privilege

Companies facing the threat of European antitrust proceedings will have to be extremely cautious when communicating with in-house lawyers after Akzo Nobel, the Dutch chemical group, on Monday lost a test case on legal privilege.

The decision by the European Court of First Instance was condemned by the Law Society, representing solicitors in England and Wales, which said it was concerned the outcome would “harm the interest of improving business practice”.
