The High Court has paved the way for a legal challenge to a decision to withhold government defence documents filed in a court case relating to the scrapped probe into BAE Systems, the arms maker.

Mr Justice Collins yesterday said he had "sympathy" with a request made to him for disclosure of the documents, but added that he wanted to give the court authorities a chance to argue why they should remain confidential.
